User Agreement

This page tells you the terms and conditions on which you may make use of our Sites and Services, whether as a visitor or a registered member. By registering, accessing or using SecuritHub.com, SecuritHub branded and non-branded apps, and any other SecuritHub-related site, you agree to enter into a legally binding contract with SecuritHub, and by extension with NextGen 5.0. If you do not agree to this User Agreement do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Sites and Services. Please note that this User Agreement may be modified at any time and without prior notice.

 

Changes and Updates

We may revise this User Agreement at any time and without prior notice. We will post any changes on this page and update the date at the top, so be sure to check back periodically to stay aware of any modifications. Your continued use of our Sites and Services after changes have been posted will constitute your acceptance of this User Agreement and any changes made to it.

Information About Us

​

SecuritHub.com and any other SecuritHub-related site are operated by NextGen 5.0, a non-profit organization registered in Italy (C.F 94090420277 ). Our main trading address is Santa Croce, Venice, 30135.

 

Accessing Our Sites

​

Except for some public pages (e.g the homepage), the access to our Sites is restricted to our registered and approved members. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

 

When using our Sites and Services, you must comply with the provisions of our acceptable use policy detailed below. You are responsible for making all arrangements necessary for you to have access to our Sites. You are also responsible for ensuring that all persons who access our Sites through your internet connection are aware of these terms, and that they comply with them.

Obligations

​

To be eligible to use the Sites and Service, User must meet the following criteria and represent and warrant that it: (1) is 18 years of age or older (in the case of individuals); (2) is not restricted from the Service, or not otherwise prohibited from having a SecuritHub account; (3) will only maintain one account; (4) will not create an account with false information; (5) has full power and authority to enter into this agreement; and (6) is not a direct competitor of SecuritHub or a provider of a directly competitive service.

 

By registering and creating an account you agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account; and (3) follow the law and our Community Guidelines. You are responsible for anything that happens through your account unless you close it or report misuse.

 

User may use the Service for no charge or for a fee, depending on the membership plan selected when signing up. If you decide to purchase any of our paid membership plans, you agree to honor your payment obligations and you are okay with us storing your payment information. You understand that there may be fees and taxes that are added to our prices. Failure to pay the annual membership fee associated with your plan will result in the termination of your paid Services. Also, you agree that: (1) your subscription may be subject to foreign exchange fees or differences in prices based on location; (2) your payment method may be charged automatically at the start of each subscription period (to avoid future charges, we recommend you to cancel your plan before the annual renewal date). (3) you will keep your contact information up to date and you are okay with us providing notices and messages to you through our websites, branded and non-branded apps, and contact information.

User Policies

​

Renewal 

SecuritHub memberships renew automatically to ensure that access to plus and premium content remains uninterrupted as you use our Sites and Services. Members are reminded of the renewal 30 days before the annual renewal date. If any changes were to be made to the pricing or level of access linked to a membership, we would notify members of these changes at least 45 days before they were to take effect.

 

Cancellation 

If you do not want your membership to be renewed, you may cancel it at any time by following these simple steps:

  1. Go to your dashboard and click “Manage Account

  2. Click on "My Membership Plan

  3. Click on "Cancel Subscription

 

Once cancelled, all the features associated with your membership plan will remain active until the end of your billing cycle.

 

Refund 

SecuritHub memberships and subscriptions are NON-REFUNDABLE. We do not provide credit, refunds, or prorated billing for cancellations done prior to the end of your billing cycle. Please cancel your membership or subscription prior to renewal to avoid recurring payments.

Rights and Limits

​

You own all of the content, feedback and personal information that you submit or post while using our Sites and Services, but you also grant SecuritHub, and by extension NextGen 5.0, a non-exclusive license to use, copy, modify, distribute, publish and process, information and content that you provide through our Services, without any further consent, notice and/or compensation to you or others. You can end this non-exclusive license for specific content by deleting such content from our Sites and Services, or by closing your account. 

 

By registering, accessing or using our Sites and Services, you agree that we may access, store, process and use any information and personal data that you provide in accordance with our Privacy Policy and your settings’s choices. You also agree to only provide content or information that does not violate the law nor anyone’s rights, and that your profile information will be truthful. 

 

By using our Sites and Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. While we constantly monitor and review content provided by our Members, you acknowledge that we are not responsible for such content, and that any opinion, advice, statement, service, offer or information presented or disseminated on any bulletin board or any other member-generated page are those of their respective authors who are solely liable for their content.  We cannot always prevent the misuse of our Services, and you agree that we are not responsible for any such misuse. You may want contact us to report inappropriate material or use the reporting features within the Sites. 

 

We reserve the right, in our sole discretion, to edit, refuse to post or remove any material submitted to or posted on any user or user generated pages, and to restrict, suspend, or terminate users accounts if they breach this Contract or the law or are misusing our Services. Our failure to exercise this right does not in any way constitute a waiver of that right, or endorsement or approval of any member-generated material.

Intellectual Property Rights

​

Our Site and its content (including but not limited to, animations, character design, text, software, music, lyrics, sound, photographs, graphics, video, audio, infographics page layouts and design) are protected by intellectual property rights. SecuritHub, and any other SecuritHub trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of SecuritHub.

 

Except where expressly provided otherwise, original SecuritHub works are licensed for use under the Creative Commons Attribution-Noncommerical-Share Alike 3.0 license. All other rights are reserved. For commercial or any other use, prior written permission must be obtained from SecuritHub, and by extension from NextGen 5.0.

 

We may make use of others' works in compliance with their terms of use when published, specific grants of permission, and/or generally accepted fair use. If you are the copyright owner of material that you feel we are using inappropriately, contact us with your specific concerns so that we may address them.

 

Some material presented in our Sites may be subject to copyrights of other parties. We take reasonable care to note it as such, include original source information, or use terms such as "reprinted with permission" that are indicators the work is not an original SecuritHub work. Re-use of such material is guided by the originator’s terms, not SecuritHub or NextGen 5.0.

Our Sites Change Regularly

​

We aim to update our Sites regularly, and may change the content at any time. If the need arises, we may suspend access to our Sites and Services, or close them indefinitely, at any time, for instance, for operational, regulatory, legal or other reasons. Any of the material on our Sites may be out of date at any given time, and we are under no obligation to update such material.

Our Liability and Disclaimers

​

The material displayed on our Sites is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group and third parties connected to us hereby expressly exclude:

 

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Site or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, including, but not limited to, any implied term of satisfactory quality, fitness for a particular purpose and any standard of reasonable care and skill; and loss of income or revenue. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

 

Your use of our Sites and Services is at your sole risk. Our Sites are provided on an "as is" and "as available" basis and we do not guarantee that our Sites will be suitable for your purposes or requirements.  If your computer does not support relevant technology, including encryption, you may not be able to use certain services or access certain information on our Sites. We will not be responsible for any failure of electronic messages or images (whether via the internet or SMS) sent through the service to reach your intended recipient on the date specified by you.

 

Our Sites are accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We do not represent that our Sites are appropriate or available for use in any jurisdiction other than Italy. We shall have no responsibility for any information or service obtained by you on the World Wide Web.

 

The content of our Sites has been compiled from a variety of sources and is subject to change without notice. We use reasonable care in compiling and presenting the content of our Site, but we give no guarantee that the content is complete, accurate, error or virus free or up to date.

 

We do not assume any liability, or responsibility, for any content uploaded or otherwise transmitted by you or any third party to our Sites. Any indemnity given by you under these terms of use shall include indemnification of both us and our staff against any and all claims, damages, liabilities, costs and expenses, including reasonable attorneys’ fees, arising from the breach of any of your obligations hereunder.

Service Provision

The Parties do not provide any warranties or guarantees as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on our Sites for any particular purpose. Users acknowledge that such information and materials may contain inaccuracies or errors and Parties expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.

 

From time to time, the Sites may also include links to other websites. These links are provided for Users’ convenience by providing further information. The inclusion of such links does not signify that the Parties endorse any referenced websites.

 

The Parties holds no responsibility for the content of linked on our Sites. The Parties maintains no responsibility for, nor endorses any, comments, questions, feedback, and ideas expressed in the content of any websites to which the our Sites may present links, and does not maintain any affiliation or association with the operators of any such websites.

User Conduct

​

Users may not use the Sites to: (1) perform any activity which is or may be, directly or indirectly, unlawful, including, but not limited to, any acts which may be deemed to be, in any way, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful or racially, ethnically or otherwise objectionable; (2) perform any activity which may breach a third party right; (3) engage in commercial activities, including but not limited to, offering for sale any products or services, soliciting for advertisers or sponsors or selling, licensing or granting public access to any materials or information displayed on the Site; (4) share views which justify, promote, incite, or support violence to achieve any number of social, religious, or political changes.

Data and Privacy

User data is subject to our Privacy Policy. You understand that through your use of the web portal you consent to the collections, storage, and use as set forth in the Privacy Policy of this information. The Privacy Policy is available at this link.

Branding

​

The Parties grants users no other privileges or rights in the Sites or any current and future content displayed on the Sites other than the limited rights of access to and viewing of the content. Users acknowledge that any other use of the Sites, including without limitation, reproduction, modification, distribution, transmission, republication, display, performance, translation, reverse engineering, de-compilation or disassembling, creation of derivative works, exporting, selling, licensing, renting, leasing, transferring, or otherwise transferring rights to the works, or removing any proprietary notices or labels on the works, without the prior written permission of the Parties is strictly prohibited, such permission to be granted at the discretion of the Parties on a case by case basis.

 

Unless expressly stated otherwise, all logos and other service marks, brandings, trademarks, page headers, custom graphics, and button icons that exist in the Sites are service marks, trademarks and/or trade dress (collectively, the “Marks”) of SecuritHub, and by extension of NextGen 5.0.

 

Users agree not to display, use or reproduce any of the Marks in any manner without the prior written consent of the Parties.

 

Without limiting the generality of the foregoing, the Parties specifically prohibit the use of any Mark as a “hot” link to the Sites unless the establishment of such a link is approved in advance by the Parties in writing. Failure to obtain such approval shall entitle the Parties to seek an injunction enjoining such use.

 

All other trademarks, service marks, product names, and company names or logos displayed or cited on the Sites are the property of their respective owners.

Breaches of the User Agreement

​

Without prejudice to Users other rights under these terms and conditions, if the user breaches these terms and conditions in any way, the administration of the web portal may take such action as it deems appropriate to deal with the breach, including suspending the user’s access to the website, prohibiting the user from accessing the website, blocking computers using the user’s IP address from accessing the website, contacting the user’s internet service provider to request that they block the user’s access to the website and/or bringing court proceedings against the user.

Miscellaneous

​

The Parties may terminate a User’s access to the Sites or discontinue or modify the content at any time without prior notice to the User. A User’s continued use of the Sites following any such modification will constitute acknowledgement of said User’s acceptance of said modifications.

Governing Law

​

The Terms and Conditions of use for the Sites are governed by, and shall be construed in accordance with, the laws of Italy.
